I have to ask a Question I am in Ontario Canada and I have been married now for
Almost 5 years.My Husband has gotten me to sign a Marriage prenup which I don't have a problem with in ways.I believe in a Marriage you share everything but his Grandmother has past away and left him her house which we both live in together.
Him and I have talked about Divorce many of times.I have heard that a Marriage prenup
Only lasts for five years of your Marriage and then you have to get it updated is this right or Wrong?I don't want his House as this house was given to him by his Grandmother
But I would like to know as I thought a Marriage prenup was for as long as you are married.You see I signed the Marriage prenup a week after we got married.I did not have too.Please Help

If you were already married, then you could not have signed a pre-nuptial agreement, but rather a post-nuptial agreement.

Did you each have your own lawyer when you signed? Did you make changes or just accept what he gave you?

If you answer know to either one of those, then odds are in the case of a divorce, you get could the pre/post nup invalidated.

You have been married 5 years and talked about divorce MANY times?

It is smart to talk about it before you get married, but why constantly?

Are you sure this is even the guy you really want to spend the rest of your life with?

I was under the impression that a pre/post nup lasts for the entire marriage, but check the Ontario statutes more thoroughly or just ask your lawyer who advised you on the pre/post nup.

I believe it would be under F, under the “Family Law Act”
