I would like to know how to evict a guest that has been in my house for 6 months. She is using illegal drugs in my home and I fear for my personal and property safety. I never had her pay any rent or any household bills. Do I have to serve her a 3-day notice to vacate or can I just consider her a trespasser?

I'd say give her 24 hours to get out, and if she gives you trouble or isn't gone by then call the police. You didn't sign a lease, you have no obligation to let her stay. Sounds like my mother.. Her name wouldn't happen to be Angela would it?

Guest or not, visitor or not, if she is living at your residence she has to be evicted according to State Law. The Police will most probably not get involved because this is a civil matter, not a criminal matter.

She's been using illegal drugs and doing whatever else for 6 months and you just noticed that now?

At any rate - evict her according to State Law. If she is dangerous, go to Court and get a protective order. That will keep her out of your house.

Your advice is inappropriate and incorrect AND could get someone in serious legal trouble.

If you have a site that says this is the legal way to evict in Georgia, please post it.

A houseguest is someone who stays a day or no more than a couple of weeks. After 6 months, this person is now a resident. A resident has to be formally evicted according to the laws in your area. You cannot give a 3 day notice, because that assumes that she is required to pay rent. But as a resident without a lease, she is considered a periodic tenant. She has to be served a vacate notice with a time limit appropriate for the area. (ANY question on law needs to include your general area as laws vary). That time limit can be anywhere from 14 to 60 days depending on locale.

There is a caveat here. If she is selling drugs then call the police on her. When they arrest her, get a restraining order to keep her away from your house.

Otherwise, ask her to leave and tell her that if she doesn't leave you will be forced to start the eviction process. If she refuses then start the process.
