If I am self employed can they garinsh my income, all the income I am now getting is paid to me on a misc 1099 form, I have a credit card company telling me they will take my house, and garinsh my income, can they do that?

They can't take your primary residence over a credit card debit... but the courts can garnish bank accounts, and even tax refunds.

But the credit card company can't take any of it themselves, there has to be a judgement in court they would have to win before they can even file for garnishment.

Garnishment refers to salary. So if you aren't being paid wages, there is nothing to garnish. However, if you are getting a regular check even though its 1099 income that could be garnished in some states.
