My mother has Alzheimers and lives with my Step Father, He is 87 and growing frailer by the day, He can no longer take care of Her. He refuses to go into assisted living or to let Her go. Do I have the right to go in and force the issue for both of them or just take my Mother?

You must prove both of them as incompetent .They must be declared incompetent .
If he is legally of sound mind, you can't force him to go anywhere... and probably you can't force your mother,too

No you do not, and while something may need to be done, I am not sure taking your mother away from her husband that she loves is the thing to do.

Perhaps force both of them into an assisted living, get them to use a home health care agency or something else
