This annoyance tactic involves the use of a camera trained on a neighbor's property, and when the neighbor walks around his own house at a certain location on his lot, the offending, annoying neighbor makes a physical appearance on his own property, so as to be sure and be seen by the targeted neighbor. The appearance involves no words, nor even eye contact, and is not threatening. Ample tests have been made to rule out randomness of these "appearances," of which there is a record of hundreds. The intent seems to be to exercise some kind of repetitively annoying psychological effect on the targeted neighbor, who desires no contact with the annoying neighbor, given the unpeaceful history of the neighborhood, and the generally unharmonious spirit of the neighborhood. This seems to be a conflict of rights: Does the annoying neighbor have the right to exercise such an imposing, ongoing surveillance of the targeted neighbor and to impose, although passively, his physical presence whenever he sees the targeted neighbor appearing? Several circumstances suggest that the offending neighbor is being paid or otherwise put up to conducting this virtual siege against the peace-loving and privacy-loving neighbor. As to the rights of the targeted neighbor, does he have the right to be on his private property minding his own business without having to have any contact with the neighbors or contend with neighbors who, for whatever purpose, are intent on annoying him on a repetitive basis?

Well of course the targeted neighbour has every right to enjoy his property without annoyance, albeit, a non violent one. And as you describe it, there is no confrontation.
If you are planning, or contemplating a rebuttal to this annoyance, you can't really, because there is no confrontation, to physical contact, no words exchanged.
Of course, this type of annoyance would drive me crazy, so I sympathize.
What actually precipitated this attitude on the part of your annoying neighbour?

He even has the right to make eye contact with you from his own property. The solution? A BIG tall fence.

The neighbor can do anything they wish on their own property so long as they don't leave their own property. They can even go as far as say for instance brandishing an axe at the "innocent neighbor" and screaming death threats but NOT leaving their own property while doing this. Yep, perfectly legal thing to do.
As far as the camera or video camera - that's perfectly legal as well as it is aimed at "public property" and not directly into the neighbor's windows. Even if it was aimed at the neighbor's windows all the neighbor would be able to do is shut the curtains or blinds.
It's all a "psych out" situation and the "innocent neighbor" is obviously imtimidated by this. Why bother giving the nasty jerk even a glance at what he's doing?
Excon has a great solution even though it may cost a small fortune and I would highly recommend it as well. Contact your city/county and see just what is the highest allowable fence and of what material that can be legally erected between the properties and DO IT. Then you don't have to be "bothered" by the nasty neighbor constantly looking at you when you are outside.
The psych out is commonly used to really unnerve people and apparently this tactic has successfully worked on you.
