View Full Version : Can I get back child support if adoption is in progress?

My Ex husband was ordered to pay child support for our two boys after our divorce, he came and visited them once and has never paid a dime. I was 18 and didn't know how these things worked. I got remarried and my current husband has taken over and has been doing so for almost 7 years. He wants to adopt them and my ex is more than happy for him to do so since he gets away scott free, in a way now that I've finally found him I want him to pay! But then again I want them to be rid of that last name. Can my ex be ordered to pay back support even if an adoption is going to take place?

Yes-if he was ordered to pay child support, he has to pay for all 7 years + interest.

Most places have an agency that helps collect child support. Contact that agency and show them the court order ordering support. They will help you collect from the date of the order until the date of adoption.

Okay so Im kind of getting two different answers... No matter what do I get back support... or I only get back support up until the adoption is complete?

If there is a support order, then he owes you support until the adoption is finalized and his obligation ends. He will continue to owe that amount until its paid off, but no further amounts will accrue once the adoption is finalized.
