I am legally married but his name is not on my daughter's birth certificate... he never wanted the kid... does that make me a full guardian? What do I do to get divorced? I don't know where he is... I'm in Florida I don't know if that affects anything! Thankx

If your married then the child is also his until a court says different. You file for divorce. Its best to talk to a lawyer near you and find out what they charge.
