View Full Version : In the state of Alabama, how will filing Chapter 7 affect someone else's property?

My husband and I have a combined credit card debt of around $28,000 after interest and late fees from several different cards. We have a house that we purchased year before last but have been unable to pay on since my both my husband and I lost our jobs at the end of last year. We left the house and it is pending foreclosure. Several cards have been turned over to collectors. We have a points based timeshare that hasn't been paid on either. We have just had a baby and have steady income again. We don't have anything to spare if we have a judgement against us. We wanted to file chapter 7 but was informed that they will sale my mothers rental property since my name has always been on the deed as co owner. Any suggestions? What can this lenders do to us? How much can be garnished from wages? Can my mothers property really be seized even though I have never done anything with it?
