My daughters bio-father is absent from her life and has been for a year now. My husband is in the military and wants to adopt her. I had to get custody papers to get her visa because we got stationed overseas. I have sole legal and physical custody of her. I do not receive child support and he has no contact with her. So my question is can my husband adopt without me having to find her bio-father/

Maybe. Adoption is a legal process and needs the approval of a court. The court will require that you make at least a good faith effort to get the bio father to relinquish his rights. What constitutes a good faith effort will vary from court to court.
Retain a Family Law attorney to prepare the adoption petition. The attorney will not what efforts you need to make.
