View Full Version : How long can a father not pay child support in ga before losing their rights

I live in ga and have not received child support in over a year, the child support enforcement tells me that they can not enforce any kind of action because the father has applied/receiving disability. My son's dad does not call him or see him but about once every 6 months. I would like to know how long does it take fro someone not to pay their child support and have contact with their child in the state of Ga. Before losing rights, we were never married so would he have any rights to begin with?

If there is a child support order, then he is the legal father. That gives him the same rights as any father. His rights will not be taken away because of non payment of support (especially if there is an inability to pay). Nor will they be taken away due to non contact.

Of course he has rights, that is why he had a order to visit the child ( I will assume) and that is why you were able to get a child support order.

In GA merely not paying and not visiting is NOT a reason to take away his rights.

If he is on disability, he should have went back to court to get the child support reduced to match his income.

Also have you applied for payment though disability for his child ?

But he has rights, and it can not be taken away in GA for merely not paying.
