Someone Illegally cashed my refund check. What can happen to the individual?

Depending on the level of the refund, the person who illegally cashed the check has committed:

- Check fraud
- Simple theft or Grand theft.

That is at the STATE level. Cashing someone else's refund check is also a FEDERAL crime, on which the IRS takes a rather dim view.

You of course have to report the theft to the IRS in order to recover the refund.
