I am allowed to claim my son until no longer eligible to be claimed.. He turned 18 last year. I am paying tuition for his school would I still be allowed to claim him on my taxes and write off the college expense?

What does your divorce paperwork state? Is your son going to be living at home full-time or is he moving out?

He lives with his mother full time. The divorce paper just states till he is no longer eligible to be claimed as a dependent.

So where is he going to be living? At home with his mother or in a dorm/apartment by the school?

He will be living at home with his mother. But we are paying for the tuition.

Double-check what your paperwork states. My husband's specifically states that he pays child support until the child is 18 or it will continue if the child is attending college full-time and still residing at home with the custodial parent.

If he doesn't have his own job and you are still paying support, I don't see why you wouldn't be able to claim him.
