View Full Version : Can child abandonment charges be filed against me.

I sent my child to family members so I could go to treatment. I gave them temporary guardianship until I got my situation settled. I'v asked repeatedly to have her sent back but they will not. Its all most been a year. I am now going through the courts. Can they file child abandonment against me.

As stated in the link, abandonment would have been if you had left the child alone without supervision. You granted them temporary guardianship until you could get on your feet. As far as I'm aware, the only way to get primary custody back is through the courts.

No they can't claim abandonment. The guardianship document would preclude that.
How was guardianship conferred? Was it done through the courts or did you just sign something. Was there anything in the document or court order that indicated this was temporary?
Why didn't you go to court IMMEDIATELY after they refused to return the children? Why has this dragged on for a year?
