View Full Version : How do I change jurisdiction to my home state of WV?

Divorced in 2008. Domestic Violence injunction against Ex-husband who became more crazy after divorce. 2 Children in which I have sole parental custody. He was charged with stalking by the state of Florida where we lived at the time. I agreed per my lawyers advise to sign a Joint stipulation to modify for the safety of the children (theraputic Supervised Visitation for ex-husband only) Then, After my lawyer in November 2009 took me to a public park and let my ex verbally threaten me, I fired the lawyer, and clled his parole officer, my ex-husband was arrested for violation of the injunction I fled to my home in another state with the children. My ex tried to file contempt in March 2010, but was found in my favor because there is no court order saying I cannot move in our divorce decree (per the judge). Hired an another lawyer to file to change jurisdiction for any further motions by my ex, and that lawyer changed her mind after payment and conversing with my ex! She said I should travel to Florida to comply with the supervised visits, even though the psych center said no they closed the case and would not handle it due to inactivilty. My ex husband kept contcting them and now they have a psychcologist willing to handle it. I do not have this kind of money, or time to travel 1500 miles to force my children to see him! They spent a year in counceling to get rid of their fear! What can I do or file? We have lived here 9 months, and I own a home, as well the children go to school here. We want out of this abuse! To top it off the lawyer wants another deposit! I am broke! Cannot afford this, and I want my life back, as well as the children want to feel secure. Help!

Petition the Court to have the matter heard where you are. I don't know, however, if you've established residency in the home State - and that is important.

I own a home in my state. The children go to school here. We have been residents since 2009. Do I petition my home state or where my exhusband is and jurisdiction still is?
