My step-son's ex has made a threat against my life. (states she is going to slash my throat). He has her making this statement on an audio tape. I know she does have anger issues and I believe she is psychotic. She went before an administrative judge for social security and told him when she is off her medication, she takes her anger out on her children. (She did receive benefits after this hearing with the administrative judge due to her anger issues.) There have been numerous open cases against her with Children's Services Departments in various counties in her area. She gets an open case in one then moves to another county until the heat dies down & then moves back & forth from county to county. Her own son told me that he is afraid when he is at mommy's house. Also, she has threatened to jump off a bridge in the area to the point where she has been on the bridge & was talked down by law enforcement several times. . My question is: can I get a protection order against her?? I have to drive my step-son to pick up his son at her home for his visitation.

If the situation is not important enough to protect your grandson, then it's not important enough to protect you.

Do you understand what I just said to you?? Your grandchild is in danger, and you STILL let him visit. Until you STOP that, I can't imagine you really think she's dangerous. Or she IS, and you don't care much about your grandson...

So, what is it?

FYI--We have reported her over & over to children's services. As I stated earlier, when the heat is on for her she moves to another county. Children's services in that area do not follow up or communicate with other counties. We have wellness checks done on this child over & over & over again. We have people that live near her, watch the children when they are in the yard. It is not a matter of us not caring about this child. The child's custodial parent is the mother; seems like you didn't read the question very well. You have the situation totally turned around against me and not the person who is really the bad guy in the situation who is the mother. We just tried the other day to pick him up for visitation with his father & when we arrived she had left knowing we would be there to pick him up at the designated time. Oh and by the way excon, you do not have the legal experience from your first hand experience with the legal system through your own crimes to answer legal questions. Don't try to be a jail house lawyer. You Are Not Qualified. And by the way law enforcement in that area is the equivalent of the law enforcement in Mayberry;they don't want to get involved. We had to almost beg them, when we went to pick up my grandson, to file a report. There are steps being taken to have contempt of court charges against the mother for not only her anger issue but also for not following the visitation schedule or the mediator's advice who is qualified unlike you. Too bad you didn't drink the koolaid.

I think you are misunderstanding what Excon is saying...

If you are so scared of her... take her back to court to get custody of the child. Stop reporting her to children's services, stop playing games.

If you care for this child get an attorney and fight for his safety. He is an INNOCENT child. Protect him.

Definition of insanity,short version=Doing the same thing over and over,expecting different results.

I agree with what excon stated and how J-9 explained his response,can you understand where they are coming from?

The legal definition of aggravated menacing is KNOWINGLY causing another person to believe (loosely) that they, their family members, their possessions, are at risk.

Take the tape (if it's legal in your State. If not, be prepared to be charged with illegal taping) to your local Family Court and at least attempt to get this child away from the mother.

This isn't the first nor will it be the last time that the Police have refused to become involved in a domestic situation. If the mother and father are "feeding" off each other the Court will discount BOTH sides of the story!
