If we paid a deposit for something and it did not say anywhere that it was non refundable and the seller sold it to some-one else are we right to ask for a refund?we
Have asked the seller and they have said no!

No live chats here and I don't think there are any solicitors posting.

If you want an answer to your question - if the contract is silent (doesn't mention) where the refund of the deposit is involved, yes, you can sue. You paid, you didn't get the merchandise, the seller owes you your money.

My only other thought would be whether YOU broke contract. If you did - no deposit is coming back to you.

Probably. Where do you want to move their bodies to? Contact an undertaker, in the country where they are buried, to make the arrangements.
