I am a software developer working for a client company as a contractor on behalf of third-party smaller company. Although it was agreed upon, I still don't have written contract with the third-party company - only verbal agreement and chain of e-mails supporting verbal agreement that I'll be paid on 1099 that much $$ / hour. I work regular hours on the site of the client using their computer. They also approved and asked me to work extra hours if I could and do it. The third-party (my "employer" ?) receives my weekly reports of the number of hours worked.

Two weeks ago I asked "my employer" what is the pay schedule. He promised to find out what the pay schedule is at their accounting department and get back to me ASAP. So far he did not. By 07/16/2010 I worked full 3 weeks, but did not receive any pay. I feel very uncomfortable now.

Where should I start? Should I go to HR of the company I work for on behalf of "my employer"?

Please help.

Thank you in advance,
B.

Your first step is to contact the company you have a contract with. They are responsible for paying you. If they don't pay you tell them you can no longer do the work, until you get paid.
