My ex-husband and I have joint legal and physical custody of our 2 year old daughter. We live in Maryland. I want our daughter to attend a private preschool at age 3 years, as opposed to daycare and my ex is opposed to our daughter attending a private preschool. I am not asking him to pay any tuition for the private preschoool, as I would pay all tuition and school fees. Do I have any legal rights in asking the court to allow our daughter to attend a private preschool over daycare.

He does not want her to attend school before age 5 years because he wants her to attend public school.

That's just silly.
My MIL is a 4th grade teacher, she can tell the difference between the children who attended day care, preschool or stayed at home with mom/dad.
There is a major advantage to preschool, although some may not agree.
This day and age, when schools are pushing multiplication in the second grade, every child needs a boost. Preschool can do that.
It's not like back in the 70s when we were just learning how to read in second or third grade. Now the children are expected to learn what we learned in fourth or fifth grade.
Preschool gives the necessary boost. Not only intellectually, but socially as well.
