Can you get child support from the grandparent if the father isn't paying the child support

No. The responsibility is that of the legal fathers. You can't put this onto someone else. How old is the father of the child?

My child is 3 and his birth father hasn't been paying it for more than a year we have court orders and he still isn't paying them can I sue his mother to get the money since he won't pay it an she's always involved with my stuff my child has a good father in his life and wants to adopt him but the "donor" won't let me. Any suggestions?

You keep chasing after the father. And maybe after a night in jail from accumulated arrears then he may allow the adoption.
Its his and his alone to pay it.

Trust me he has been in jail more than once for this and other offenses. Trust me I'm not looking for me. I want him to leave and let me and my to be alone and move on..

Then hire a lawyer and if he doesn't visit the child nor pay support you can ask the courts to terminate his rights so as to allow for an adoption to happen.

If the father has been in jail and you have a husband willing to adopt, then you stand a good chance of getting his rights terminated. Have you consulted a Family Law attorney? You really need one to prepare the adoption petition. Your attorney can advise you how to get the bio father's rights terminated.

If you are not married to the man who wants to adopt, that may throw a kink in the works and most area require you be married to allow a step parent adoption. Again an attorney can explain all this to you. I don't understand why the bio father won't allow the adoption since it frees him from his obligation for support.

But to answer your question, the grandparents have no liability here and cannot be sued.
