View Full Version : Can a woman decide she no longer wants child support from father

I am paying child support for a daughter that is 6, that I have not seen since she was 4months. The reason, I am charged with a felony for child endangerment. Was never married to the mother, and have been paying child support all along. Mother of my child now has another child with a man she is living with. My question is, can mother decide she no longer wants child support from me legally? If she is OK with this can it be done? We both live in SC, so would like info from this state. Child support is going through GA. Right now where we use to live and has never been changed to SC.

If it is court ordred then no she can't just decide not to have you pay it. It could get you in a lot more trouble. The only way its going to happen is if the new husband adopts the child. Then you can be released from your responsibilities.

Why were you charged with felony child endangerment?

No she can't you can try to get it reduced, but GA sets the payment based on your income. So it ishard to get it changed outside their guidelines.

Next why are you not seeing your child, you could get supervised most likely reqardless of criminal record

She is now living in SC, and from my understanding, needs to let Ga. Know that she has moved to another state. If Ga. Closes the case, does the mother have the option of not opening a case in SC?
