View Full Version : I want to live with my dad but my mom has half custody.. what are the MN laws on this?

I'm 14 and live with both parents (50/50 custody) every other week. They just divorced recently. My mother doesn't take care of my siblings (10 + 8) well. Her ways of disciplining us don't work, she shouts at us because she has a short temper, she is fake, she doesn't have good expectations about what we do in school..
When we are at dad's we are dream children. We clean up, do our homework before it get's late, and still have fun. Dad is raising us to be better children, so does that make it in our best interests to be there more often? Especially if none of us like mom's and are only scarred by her yelling at the others?


Okay, that was a little long winded. I just want to know- what are the Minnesotan laws regarding a minor's say in their custody?

Your father would have to file for full custody through the courts. The judge will very likely ask your opinion on the matter (and perhaps your siblings, although the 8 year old, not as likely). Keep in mind, they are your feelings, which are generally considered, but not written in stone.

The key here though is you, as a child, cannot do anything about this. It HAS to be your father who files for a modification to custody.
