View Full Version : Custodial parent wants to leave New Jersey - what to do about child support/ alimony?

My husband's ex-wife wants to leave NJ to move to GA with their two children. He is distraught. She has filed no motion and doesn't care that these children will desperately miss their father.
He currently pays ~$1K per week in Alimony and Child Support. If she leaves without his consent, is he obligated to continue paying both? Or just Child Support? Or can he request an order that he ceases payments until he is granted appropriate visitation?

To clarify: ex-wife has no job (Stays at Home, although she was employed full-time during marriage), and has no job prospect in new state. She has a brother there, but has more family in New Jersey, so no reason to move for family.

Assuming he is in the same state and is activitly visiting the child ?

He can file to stop her from leaving, and if she leaves file for custody of the children.
