View Full Version : Does he have any rights as the father?

My son lives in PA. His baby was born 3 weeks ago. The mother was living with him even though they were not a couple. When my son came to SC for 2 days the mother took the baby and left. She did not tell him she was leaving nor did she tell him where she was going. She will not answer any phone calls from him or anyone connected to him. The police won't help because they said that she is the mother and she has the right to take the child wherever she wants. Does my son have any rights as the father and what can he do to find his child?

He has no rights unless/until the Court grants him rights. He needs to file a Petition for visitation and/or custody in Family Court where they were living. Family Court will assist him in locating her.

Did he sign the birth certificate? He will need to go to court for support and custody. He can ask for the chid to be returned.

He did file a petition for custody but was told that unless he can serve her with papers there is not too much they can do. Family court will not assist him in locating her.

Yes he signed, but no one will help him. He has gone to the police, the courts and the FBI. What else can he do?

He needs to go to court and get custody. Without that the other agencies won't help him because as of this point he has no legal rights above what the courts have afforded him.

If Family Court will not assist him then he needs to hire a licensed private investigator to find her. No legal authority will help him because, as I said, he has NO legal rights until the Court grants them to him.
