Florida Legal clarification need;
1. HSBC is named as the Garnishee in the Writ of Garnishment. If I never had any prior dealings or contact with them does this mean they "Brought My Loan Debt" from the Plaintiff and/or are they Co-Plaintiffs or new Plaintiffs?
Asset Acceptance - Plaintiff (original plaintiffs);
2. I filed a Claim for Exemption to stop process here in Florida and file to have Judgment vacated due to no notice received from Plaintiff.
3. Is this a strong legal defense and
4. Is there a statue of limitations on this old credit card debt of $1990, 1999. It was inadvertently left out my settled and now closed bankruptcy. I was told that they would probably write it off due to Bankruptcy at the time,wrong.
A judgment obtained for $4,400 in 2005?
File was destroyed by court in 2008, No other activity until 12/2009 then Writ of Garnishment obtained with no notice of it until letters on 6/16/2010.
