View Full Version : If a costa rican father does not pay child support can he stop the child from moving

I am american and my fiancé is from costa rica. I want to get a fiancé visa for her and her 7 year old son. The father will not sign for the child to move out of costa rica. He does not pay child support at all. He does not care or see the child. I am willing to adopt the child once here in usa. Can he stop the child from moving here?

Hello:

If the question was about US laws, I'd tell you that paying child support or NOT, has NOTHING to do with custody arrangements. So, if the father was involved in his sons life to ANY degree, his mother would NOT be able to take him out of the country.

That's as it should be. You wouldn't want to lose your son because you couldn't afford to pay, would you?

Assuming the laws similar to the US, yes, unless the father will agree to terms, or after a long and expensive court fight the mother wins right to move
