View Full Version : Bankruptcy and summons to small claims

Sorry but this may take a minute. In 2003 I was left in a good deal of debt by an ex-husband, bills that I paid to the best of my ability all this time, until very recently. I have just now received a summons to small claims court for one creditor, because I just couldn't pay it any longer and neglect my family to try and scrape together the money to send them. Not to mention the stress, and physical toll it has taken. In all honesty the original loan has probably been paid twice or more due to high interest. I was considering bankruptcy and starting over, not because I want to mind you, but I just can't take it any longer. I haven't raised the entire cost for the bankruptcy proceedings at this time and most likely won't have it by the court date. Question is---Will the bankruptcy have any impact on the judgement and also if I can possibly go ahead with bankruptcy soon should I? And avoid the whole mess. Thank you for any input.
