I live in NC. Some credit card company garnished all the money in my checking account. I have never had a card with this company. I was not notified until they took the money. As it turns out the card belonged to my husband and he says it was paided off. His only income is social security. I work for the government as a gs worker for the Navy. They say they are putting the money back but have taken a week to do and it will be a week more before they can do it. Where are the laws that protect me. I can't pay my bills because they have my money. What can I do or who can I notify of this to protect me and get my money back?

If this was a joint account, they can legally freeze this. Then you will have to prove to the court what and which money in the account is yours.

So your husband needs to file with the court for a hearing, to get the judgement over turned for
1. lack of notification
2. proof that he paid the debt.

Now of course he could be lying and owed the money, after that if his name is on the account they can freeze that money
