Hi,

I am on a valid H1b employed and paid in US in USD. My project being overseas(qatar) I have been in qatar since Oct 2009.I know for tax exemtion I have to be out of US for 330 out of 365 days for which I qualify.
1) As an H1b am I eligible for this exemption?
2) Also, my fiancé works in USA on H1b and we are getting married this December. How should I file my taxes to avail of the additional married tax benefit.
3) Any do's or dont's please suggest.

Replies to these queries will be greatly appreciated.

Under U.S. tax law, the income earned while located in Qatar is NOT subject to U.S. income taxes.

If you claimed the income earned while in Qatar on your 2009 tax return, you should amend to exclude that income.

For Tax Year 2010, you will file as a non-resident alien, filing Form 1040NR.

Email me at [email protected] for details on whether amending your 2009 return makes sense or not.
