Hi I was recently involved in a fight between me and another male. It ended up with him falling and injuring his head enough to where he had to go to the hospital leaving a large wound. He is now out of anger claiming I used some type of weapon on him. This all happened at a friends house an he attacked me when I was trying to leave. There are 2 witnesses one who's house I was at said he is going to report what he saw which is the guy attacking me and he didn't see me with any kind of weapon. The other said he doesn't want to get involved and is going to say he was inside when this happened. What I want to know is what is my best option to not going to jail should I plead self defence or will I still get charged with some other charge besides assault? P.S. No police officers were called at the scene I believe he is going to try to summon me to court.. will his statement hold up against mine just because he was injured? Should I threaten him with a summons to try and get the same charge? I just want to know my best route to not ending up in jail.

His statement will stand alone if you follow my advice, because I suggest you say NOTHING to the cops if they visit you or arrest you. The only court HE can summon you to is civil court, and they can't put you in jail.

If you need to DO something, hire a lawyer.

What about my friend who's house I was at should I tell him to say he saw nothing? Because even though innocent of aggravated assault I don't want any kind of charges brought against me

Oh, I know what you want. I'm simply suggesting, given my experience, the best way to get it, is to say and do NOTHING.

Look. If the cops think you did something, they have to PROVE it. You, on the other hand, don't have to prove anything. If you mess around, like you want to do, the cops WILL discover it, and it will LOOK like you're guilty, and trying to manipulate the situation to make you LOOK not guilty. That won't help. It'll hurt.

People who aren't guilty, DON'T try to make it LOOK like they're not guilty. They let the facts stand on their own. That's exactly what you should do.
