I had worked in a MNC for last six years but my supervisor had created a situation (mental harassment) wherby I had to put down my paper on 1st May. My supervisor is considering my last day of working as 30th April 2010 while calculating my Final settlement. 1st May was Saturday and official holiday for my company.
1. can they consider my last working day as 30.04.2010.
2. On 30th I had worked late because of payroll finalisation and other works, but my supervisor is not agreeing to pay me overtime of 6 hrs. In my organisation overtime is paid to the employee who sits after 6 pm for official work. Even after my explanation of the job details, my supervisor is not approving my overtime payment.
3. he is forcefully converting my sick leave day to earned leave and deducting salary.

Please let me know how can I get back my legitimate payment from the organisation. Please provide me Indian Labour lax in this context so that I can refer those while claiming back the amount.

How much would that six hours of overtime and one sick leave mean to you in terms of rupees? Is it worth the time and effort you would have to spend fighting for it. Take for example, I spent 5 minutes to read your question and respond, that's about Rs 100 !
