Attached is a copy of a proposition given to room mate to address past issues w/c room mate in question agreed to... APRIL 01, 2008
Room mate was presented this and refused to sign but agreed verbally. In addition room mate offered to pay 950/month instead of what was offered.
I lease holder STIPULATE TO THE FACT THAT THE RENT OF ONE THOUSAND THREE HUNDRED NINETY THREE DOLLARS AND SIXTY TWO CENTS ( $ 1393.62) NEW YORK CITY, NY IS MY SOLE AND SINGULAR FISCAL RESPONSIBILITY FOR THE RENTAL MONTHS OF FEB. 2008 AND MAR, 20008 IN ORDER TO MAKE room mate WHOLE FOR ANY AND ALL PRIOR CLAIMS OF OVERCHARGED RENT.
MOVING FORWARD THE CONTRACTED AGREEMENT AT NEW YORK CITY, NY IS TO READ AS FOLLOWS:
ITEM 1:
STARTING APRIL 1 2008, I room mate AGREES TO PAY lease holder EIGHT HUNDRED FORTY DOLLARS ( $ 840.00 ) EVERY FIRST OF THE MONTH FOR THE USE OF THE MASTER’S BEDROOM IN THE TWO BEDROOM FULLY FURNISHED APARTMENT LOCATED AT... NEW YORK CITY, NY UNTIL THE END OF CURRENT TERM ( TO END SEPT. 2009).
ITEM 2:
I room mate AGREES TO PAY lease holder FIFTY PERCENT ( 50% ) OF THE CONSOLIDATED EDISON BILL ACCOUNT NUMBER xxx-xxxx-xxx AND THE TIME WARNER CABLE OF MANHATTAN ACCOUNT NUMBER xxx-xxx-xxx BILL DUE ON THE FRIST OF EVERY MONTH FOR USE AT NEW YORK CITY, NY 10009 UNTIL THE END OF TERM ( TO END SEPT. 2009 ).
I room mate WAIVE AND RELEASE lease holder FROM OUTSTANDING AND PERSPECTIVE FUTURE CLAIMS ASSOCIATED WITH RENT AT NEW YORK CITY NY
IN FINALITY I room mate WAIVE ALL FUTURE CIVIL CLAIMS AGAINST lease holder REGARDING USE AND PAYMENT FOR THE MASTER’S BEDROOM IN THE FULLY FURNISHED TWO BEDROOM APT. LOCATED AT NEW YORK CITY, NY
Room mate has now changed mind and states that room mate wants to pay even less rent or that room mate will report me to housing authority and my land lord so as I will loose my rent stabalized apt. and has not paid her portion of rent stating since everything is under my name it's my problem, if I don't agree to her demands...
I want her out how do I go about doing this??
