View Full Version : Do I have a discrimination lawsuit?

I was hired by a manufacturing company near Los Angeles. I passed all their test and was told how impressed they were with me. After two months they never called me to start work so I called and emailed them a couple times. They finally called me back and said they went with other candidates. I will bet the farm that the other candidates are Mexican or family members with less experience than I have. I want to file a lawsuit. I want to know the demographics of who their employees are. Everywhere I go in the manufacturing industry here I see the VAST majority of workers are Mexicans. I don't have anything against anyone. I just want things done fairly.

Most likely no, first of course they can hire someone else who will work for less, that is not illegal ( unless they are paying less than min wage)

And for most jobs there are dozens of people interviewed, so move on and find another job

You say you "were hired". Did you actually get an offer of employment in writing?

If you were "hired", as you say and Scott picked up on, you HAVE some remedy's. But, if you weren't, and they were only "interested" in you, then I doubt you could be successful in a discrimination lawsuit.

That's not to say they DIDN'T discriminate. It's only to say that, in order to WIN, you'll have to PROVE it, and that's going to be pretty hard to do. Even if you COULD prove it, it would be REAL expensive to do so. I have no doubt that you could find a lawyer willing to take your money to investigate your claim, but in my view, it would be a waste
