I am on an F-1 status and got married 6 years ago. My husband obtained his green card after our 2nd year of marriage. We decided to wait for him to become citizen before he would petition for my green card, as this might have been the faster route for my green card. We have a 2 yr old child together who was born in the US during our marriage. My husband will be eligible to become a US citizen in a few months.
However, I want to separate from him, but am afraid that he may take "revenge" by never petitioning for my green card.
Is there anything I can do to obtain a green card at this point by proving that this was a good-faith marriage? Or should I just stay with him until he becomes a citizen and then I get the green card, just for the sake of the green card and also not to lose my child when my F-1 expires? (I really want out of this marital torture asap, as this is the best for our child and myself).
Please help with some advice!
