View Full Version : Standard deduction in state of Oregon for student from India

Hi,

I am a student from India on F1 status and was in state of Oregon for the entire year of last tax filing year.

I files standard deduction for federal tax filing but can't I file the same standard deduction in the state of Oregon for state tax?

As India has treaty for Indian students, who may file standard deduction as against Itemized deduction, can I fill the same in the from 40N for the state of Oregon in line 44?

Please help me with this as if I can't then I am needing to pay a hefty tax now.

Oregon state tax law specifically forbids non-resident aliens from claiming the standard deduction on the Oregon return (even though you can claim the standard deduction on the federal return).

On the Oregon return, you MUST itemize.
