Tried to get expungement, judge said he had no authority to grant because I was still on active probation,Said I would have to apply for early release before any expungement would be possible.

It sounds like the judge will grant your request if he has something to base it on. I don't think you need anything proper. I would do it in a letter to the judge saying exactly what you said here. Ask him to consider your letter to be a motion and send a copy of your letter to the prosecutor. Send it certified, return receipt requested.

How much of your 30 did you do INSIDE? If you just got released, then you're going to have to do some probation time before you get off.. If you did, say 5 on your 30, and have served 7 on probation, your chances are better.

However, even IF you get off probation early, I doubt you'll get your conviction expunged right away. I'll bet there's a 10 year time (or thereabouts) of criminal free conduct that is going to be required before they'll grant an expungement.
