View Full Version : What if child allowed to live with noncustodial and no support reaffixed

What if the custodial parent (father) allows child/children to live with noncustodial parent (mother), and change of custody is NEVER reaffixed, nor is child support? Father sends money in support because it is the right thing to do; however the noncustodial parent accuses custodial parent (few years later) of not paying enough support and says custodial parent is in arrears. Now custodial parent wants "intrafamily adoption" so that noncustodial parent and stepfather can adopt child.

This post does not make sense for me.
1.The father is the primary custodian
2.The Primary custodian was ordered to pay CS.:confused:
3.The father wants to force the stepfather to adopt the child:confused::confused:

If they never went to court to change anything, actually the mother owed child support to the father even though children were living with her. ( I had to pay for 3 years that my boys were with me till I got it changed in court)
So the father can go back on the mother for failure to pay support for all the money she did not pay father ( when she had the kids)
He did not owe support, and can not be behind in support unless they changed the court order
