I'm in Idaho, my daughter lives with her mom in Riverside, Ca. She turned 18 in April. Support ended, and I am still paying arrears. Now the mother has summoned me back to court saying my daughter has a mental issue seeing a psychiatrist, therapist, outpatient clinic and other stuff. She has been taking me to court every few months, for modified support, health insurance, extended support, and anything else she can drag me in for more money. Now she says she will provide documentation from the doctors stating she is incapacitated from getting a job and keeping one. She has a license and drives her own car, goes to her own appointments, she has graduated high school, was going to cosmetology school, but has dropped out.
I will be receiving papers to view all her stuff and am scheduled to go back to court.
I have paid support and arrears responsibly. What can I have as a defense to stop her trying to make me pay above and beyond a parents financial responsibility?

What needs to occur is the findings of the doctors and if your child is incopacitated as is being claimed then they are going to need to go on SSD. As for your part there may be additions of extra expenses in upkeep and 1/2 of medical as well as insurance. But first there needs to be strict proof of everything going on. And it all has to pass legal muster. Do you know the names of the doctors treating your child? Did the mother lapse in some way and allow your child to be hooked on drugs or brought into a self inflicted state? All that needs to be sorted out.

Don't know any names of Doctors yet, waiting on court ordered documentation. I think she is enabling her to become a statistic. My daughter was born out of wedlock and her mom was an addict.
