My son is completing an application for educational benefits and he was arrested for possession of an illegal substance, but his court date isn't until August 26th. Although he's been arrested, how should he answer this question. We have an attorney, but haven't gone to court and won't until the end of August. Here's the question: Do you or the qualifying individual on whose account you are claiming benefits have an outstanding felonly and/or warrant?r

If the possession charge is a felony not a misdemeanor then yes they have a outstanding felony if the charge is a felony,

If they would have went to court and found guilty then he would be a convicted felon, if it is droped to a misdemeaner then it is not a felony.

So yes, if this arrest was a felony, then yes he has a outstanding one, since it has not went to court yet

Right now he is not a convicted felon. He could technically answer NO and be okay. Only until he's been convicted does he have to answer Yes. If the question was "Have you ever been arrested for a felony crime" then the answer would be yes. But in this case the answer is no as he has not been convicted yet. If he didn't show up in court for his court date and a warrant was issued, then the answer would be yes.
