O.k so I got charged with theft under for the second time. I am so upset. The first time I was guilty and got diversion. I am curently completying my 40 hours of community service; they have to be completed July 28th, then the charges will be dismissed. My new court date will be the 30th of this month.

Now today I was shopping for groceries and had a huge cart full of stuff. Also my 2.5 year old son and my 7 year old daughter who has chikcen pox. Needless to say it was mayhem. Anyway... I had put to cases of pop and a thing of fruit snacks on the bottem rack of my cart because my cart was full and I din't want the heavy stuff to crush my fruit. I grabbed one of the pops and said to the cashier there is 2 down there. And totally forgot about the fruit snacks. Anyway I paid for the groceries about 185 and left.

Anyway as I leave the store security grabs me. For a case of pop and the fruit snacks. I didn't mean to do this! I'm so scared because of my last offense! What's going to happen? The total for the snacks and pop was 16.00 or something like that.

Seriously I'm a student and was so gratful for the diversion program! I would never have done this on purpose! I am in Ontario Canada

Ok first this is going to ruin your diversion, since part of that is not to do another crime, so your first offense will not be dismissed now because of this. So you really do need to seek legal council since you may have to deal with the first offense again, as to punishments and now the new one

Can you tell me what happened to you the 2nd time? DId you get diversionn again? A criminal record? I need advice as I am going through this myself :(.

How is your first case finished "i.e. withdrawn, absolute discharged, or conditional discharged"?
If it was withdrawn or absolute discharged, the first case is done and iy is 2.5 years between them. If it was conditional discharged, it would be stayed for 3 years so you will have 2 cases in this time.
Since you had a diversion, unfortunately; it is most likely you can will not have it again. I hope I can help you more.
