Negative; those credits/deductions are NOT available to non-resident aliens, and a student on F-1 visa IS a non-resident alien.

F-1 student must file nonresident tax return for 5-years. On nonresident tax return, tuition and fee deduction is not available.

Could any one clarify about pub-970 education expenses treaty. In 1040NR instruction, it says Non residents can claim for tuition expenses. But has give to refer Pub 970.
Atlanta tax expert, could you please explain about this. I know this is new policy from 2009.

Sorry, but you are in error. I just reviewed the Form 1040NR instructions, and nowhere does it say that education credits can be claimed.
