View Full Version : Who's paying the taxes- the renter or the landlord?

I am renting a house and the landlord make us pay all the taxes during that time. Is that legal? Who should pay those taxes for the house?

Its perfectly legal. If the rental agreement included that you would pay the taxes.

I agree with Scott. If payment of the taxes was included in the lease, then it is legal.

However, if it is NOT included in the lease, then you have NO legal requirement to pay the taxes.

The issue here is that the "renter" actually always PAYS the taxes, normally it is merely in the form of the rent being higher to include all landlord expenses. But a landlord is allowed to require this, while not done often, it can be done

Good point. That's the argument about taxes imposed on corporations: they do not actually pay the taxes, their customers pay them in the form of higher prices.
