I'm F-1 student and work out off campus, what should I do if I get 1099 form?

I have to say firstly that I know it's illegal to work out off campus. I'm guilty, but it's too hard for me to ask school to process hardship of finance. Now I get a job to let me survive.

If I get 1099 form, what should I do to pay tax. I think I should pay something return to this country. My friends told me to apply for ITIN (TAX ID) by W-7 form. They said if we pay tax, IRS will not bother us.
1. Is it o.k. for me to apply for TAX ID with W-7 form?
2. In the first section of W-7, which check box I should tick? b. or f.
3. If I should tick f. What I should fill in h. (it's required to fill in h. if you choose a. or f.)

First, what you are doing is at worst a technical violation of your visa, and most likely it IS permitted if you need the income to meet your financial obligations while attending school.

You should first attempt to get a SSN through your school. Go in and explain what you are doing and why. I suspect you will be surprised how understaning the school will be, and they may assist you in getting the SSN.

If not, submit Form W-7 with your annual tax return to apply for the ITIN.

Check Box b on the Form W-7.

You apply for ITIN only if you can not get SSN. In your case, you can get SSN.

I did talk with school but it's tons of steps to do and takes about 6 months to do. Moreover I have to try to find a job in campus that it's impossible because one nationality of international students nominates all jobs in campus.

By the way, if I send my annual tax return, is it dangerous for me to get arrested or sent out off this country?

No, there is ZERO chance of being arrested or being deported over this issue.

The USCIS has better things to do with their time and resources than harass students who are working just to survive.
