I've had a Florida Condo since 1996. I move out in 2003 after marriage and began renting the unit. During this time I have had 5 renters and all the renters have made the same complaint about the downstairs owner - banging on the his ceiling the upstairs unit floor, making uncomfortable remarks to them, one renter even stated that the owner made a racial comment, 3 out of the 5 renters have had to call the police out to settle dispute between the two of them.
I have written to the HOA requesting their assistance with the owner more than once and no prevail. I feel that my request have been ignored because they were renters. I did express to the HOA that I can not be held responsible for the tenants reaction towards the unit owner. I have though advised the renter to ignore owner and if needed call the police out to have record of complaint.
DoI have any recourse of action that I can take against the HOA, since they refuse to assist in the matter?

I HATE HOA's, and I wish I could tell you to sue them for jillions... But, I don't know what you expect them to do. He's a cranky owner who wants things to be better than they are... Ok. What did he do other than make a jerk out of himself? The HOA isn't going to throw him out, and if he doesn't violate any of the by-laws, they can't even fine him..
