View Full Version : How do I get my boundaries from a divorce decree lifted?

I am on boundaries in my divorce that I cannot move outside two counties adjacent to the county I live in. I am getting married to a military man who lives three hours away. How do I get these boundaries lifted so I can move me and my kids to where he is stationed?

That is going to be a court issue. What is the current visitation like?

You go back to the court that made the order and petition to be able to move and take the kids with you. What is the current visitation order? That will obviously have to change if the father has much visitation. But as said that is something only the judge can do.

You will have to get the courts permission by filing a motion to modify the custody and visitation.

The problem, if the father is actually using his visits, seeing the kids on a regular basis, it most likely is not going to happen, since you will be taking his rights away from him. So if he does not agree and he is seeing the kids you will have to offer him other visits plans, like months at a time, you paying for all travel of kids to visit him and more.

Remember you are wrong in the "my" kids, it is your and his kids and his rights to see the kids wlll be protected by the courts also
