View Full Version : Can I claim back maintenance, perjury and underage sex

Made pregnant in 1976 by a 25 year old man. I was 15. When she was born, I took him to court where blood tests proved he could be the father, but not that he definitely was not. Now after 34 years my daughter has sought him out and DNA has proved he is her father. Can I claim for back maintenance, Perjury, and underage sex? He could have been prosecuted for the underage sex which is why he lied. I have had to live with the stigma of being branded a liar in my familys eyes for 34 years. As he would not admit responsibility, I did not put him on the birth certificate, and as it was his word against mine, no court order was issued.

Without a court order then no. Also he can have his name added to the birth certificate since DNA has proven him the father. Why didn't you seek child support before?

Your parents should have prosecuted him for statutory rape. Its possible that the Statute of Limitations has not expired for this crime. Some states do not have an SOL on rape cases.

But the door has closed on support and I'm not sure there was ever a case for perjury.

Speak to a local prosecutor. Since you have DNA proving he's the father and you have your daughter's birth date proving you were underage when she was conceived, this is an open and shut case. The only question is where the SOL has passed.
