View Full Version : I forclosed on someone's home, how do I get them out

I loaned someone money and in return they put their house up as collateral. They outright own it and I'm the first on the house now. I forclosed on him because of his failure to make payments on his loan. I now own the home and he is still in the house refusing to leave. How do I get him out?

What do you mean you foreclosed? The process of foreclosure can take several months. A court has to issue a foreclosure order. The previous owner has 90 days to vacate after the foreclosure is finalized. If they still have vacated by then you have to go to housing court for an eviction order.

I understand this and it did take months and now the house is in my name and he knows he needs to move but won't. Now what do I do?

You give them written notice to move, if they don't after the legal time allowed, you file for eviction though the courts
