View Full Version : Recourse for landlord failure to notify

I have been in this rental property for 16 months, on February 24, 10, the Owner of the property called me stating she wants to move back into the house. I expected and never received written notice from either the Owner or the Property Manager. In California it is state law to give notice with California Civil Code section 1946 and 1946.1. I have small children and run a business so I quickly found a new place to move into; however it was extremely inconvenient to move out at such short notice as I was unprepared with a new security deposit, and I ended up having to pay rent both at the old and new properties (the new house was ready immediately so I had no choice but to accept). What is my recourse? Should I pursue legal action against the home owner or the Property Manger?

They were required to give you 60 days notice. However since you accepted the short notice and moved its dead issue now

Were you under a lease? But it is most likely a moot point as this time.

Yes, you could have refused to move and ask to be paid prior to agree to move, but since you already moved, you agreed, so there is nothing you can do now
