Can I break the lease due to having to move to another state to take care of a sick family member, cancer, and because I can no longer afford the rent? What are the consequences? Can they sue us? I live in North Carolina and moved here recently so I have no family its just me and my husband, also Im pregnant so its just a very stressful moment.
Thanks

Hello md:

No, those aren't reasons you can use to break your lease. Yes, they can sue you. But, in most states, the landlord has to mitigate your losses. That means that he must rent the apartment as soon as he can to limit your losses. Once his losses have been determined, he can sue your for them.

Read your lease. It may allow your sub-let. If so, then that's your out. In any case, talk to your landlord. I'm sure you can work out a deal.

No - You need to have a frank discussion regarding your situation with your landlord and discuss any options which are available in your lease.
