Hey I have been living with my ex-husband, yes we are still divorced, for the past 2 yrs in Georgia, during this time he has purchased a house and both of us has spent money in some remodel repairs, our daughter is 10 yrs old, she is currently living with us, now here is the tricky part, about 4 months ago he chose to move out, was gone for about 3 months, when school let out for spring break, I took her out of town to visit with relatives, we stayed for 4 days, in the meantime, he went to the house changed all the locks, we arrived back home to find we could not get in, our local courts said he would have to evict me out of there, that was why I felt it was safe enough to go out of town, but on the morning he went to evict us our magistrate court said since we were no longer married he could just change the locks, the cops were called and stayed only long enough for me to get a few bags for our daughter and I, saying since it was his house we had to leave, it has gotten nasty because I wanted to stay in the house for the remainder of the school year, her last day of school is may 23, he did not want to do that, we left and had to leave the state to stay with family, he has been the sole support with household finances, with the best of intentions I sent my daughter back to live with my ex sister in law, until the end of the year, with the best intentions, I thought my daughter had been through enough and I knew school testing was coming up so I did what I thought best and let her continue in the same school, according to the local courts and sherriffs department I have no rights to the house even though utilities were in my name, I have lost all of my personal belongings, clothes,furniture,and he even destroyed my cat. I have been told the only action I can take is to go back to magistrate court and file a complaint, which could take months and I still will not get my things back, my ex sister in law- who I asked-to take care of my daughter , agreed she would not let my daughter be around her father unsupervised, because remember he threw her out to, has been letting her go around him, hence I can not stop that , but I guess my question is this, my daughter has not even 6 weeks of school left, I was made to leave our house, I didn't leave by choice, can he file abandonment charges now against me? He does not have my address, I have not spoken or text him since he threw us out, we were not evicted!! I know on the other stuff I have no rights, I know I will not get my cat, clothes, furniture back but please I feel I have lost everything please tell me am I on the verge to loose the one thing that means the most, can he file abandonment charges on or against me?

No he can't file abandonment charges on you. Abandonment is if you were to leave the child at a bus stop with out any adult supervision. You left her in the care of her aunt. You do need to get into court however because you will need to have custody and support worked out through the court. I suggest getting a lawyer since this has gotten to be a bit of a sticky situation.

If there is no custody order in place he could go there and pick her up. You need to do something quick.
