View Full Version : Question about VA state Form 760, married joint filing.

We chose married joint filing for Federal tax return. I only lived and worked in VA in 2009 (only income from VA); my wife lived and worked in different state (no income from VA and not VA resident).
When I choose the status of "Married Joint Filing" for VA state, where shall we deduct the taxes which my wife paid to the other state? Couldn't find it.

The Virginia instructions state that "If one spouse is a nonresident, you may not file a joint Virginia return, even if you filed a joint federal return." That should solve the problem.

If you are addressing the deduction for state income taxes, they should be included as part of the itemized deductions on page 2 and on the very next line they get subtracted out as they are not deductible on the state return.

But if I choose the standard deduction for federal filing, can I choose "itemized deduction" for the state filing?

No - You must claim the same type of deductions (standard or
Itemized) on your Virginia return as you claimed on your federal return.
